MIA – Terms of Service

Welcome to MIA!

By creating an account, clicking “Accept”, or using MIA, you agree to these Terms. Please read them carefully.

These Terms are written in plain English. Nothing in them limits your rights under the Australian Consumer Law (ACL).

1) Eligibility & Your Account

  • You must be 18 years or older to use MIA.
  • Keep your password safe. You’re responsible for all activity on your account.
  • Your registration information must be accurate and up to date.
  • If you use MIA for a company, you confirm you have authority to do so.
  • Tell us right away if you suspect unauthorised access to your account.

2) Your Licence to Use MIA

  • We grant you a non‑exclusive, non‑transferable, revocable licence to use MIA for personal, non‑commercial use and for your internal business purposes, according to your chosen plan (Free or Pro).
  • You must not: reverse engineer, copy, sell, rent, or modify MIA; bypass technical limits; remove notices; or use MIA in ways that break the law or these Terms.
  • Some features are only available on paid plans. We may change or add features over time.

3) Your Content & AI‑Generated Output

Your Content (“Customer Data”):

  • You own all content and data you provide to MIA.
  • You give us a limited licence to host, process, and display your content only to provide and support the service.
  • We do not use your Customer Data to train or improve our AI models. We may use de-identified, aggregated usage metrics to improve MIA and its features.

Output:

  • You own the content MIA generates from your input (the “Output”). To the extent we have any rights in Output, we grant you a non-exclusive, royalty free license to use the Output for your own purposes.
  • Outputs may be similar to content generated for others. We do not guarantee uniqueness or that Output is free from third‑party rights.

Usage Data & Improvements:

We may collect de‑identified usage metrics to improve MIA (for example, feature usage and performance). This data does not include your Customer Data.

Retention, Access & Deletion:

You can export or delete your content via your account or by contacting support. If you close your account, we will delete or de‑identify your Customer Data within a reasonable time (generally within 30 days) unless we’re required by law to keep it.

4) Payments, Subscriptions & Cancellation (Pro)

  • Pro plans are billed in advance monthly or annually and auto‑renew unless you cancel before the end of the current billing period.
  • You can cancel anytime in through the link in settings. Your access continues until the period ends.
  • Fees are non‑refundable, except where required by law (including under the Australian Consumer Law).
  • Prices may change. We’ll give at least 30 days’ notice of any increase. If you don’t agree, cancel before the next renewal.
  • Taxes may apply. If you subscribed through an app store, that store’s billing rules may apply and cancellations must be managed there.

5) Acceptable Use

Help keep MIA safe and fair. You agree not to:

  • break the law or infringe others rights;
  • upload unlawful, harmful, or infringing content;
  • send spam, malware, or attempt to bypass security;
  • reverse engineer, scrape, or interfere with MIA’s operation;
  • use automated tools except through documented APIs; or
  • overload MIA or misuse free/intro offers.

We may suspend or terminate accounts that break these rules.

6) Warranties, Disclaimers & Liability

  • We provide MIA using reasonable care and skill. However, software can have bugs and downtime.
  • MIA aims for 99.9% uptime but provides no SLA guarantees
  • AI disclaimer: MIA uses AI. Output may be incorrect, incomplete, or inappropriate. You must review and verify any Output before relying on it. MIA does not provide professional advice.
  • To the maximum extent permitted by law, we exclude warranties not expressly stated here. Your non‑excludable rights under the ACL remain.
  • Where permitted, our total liability for all claims in a 12‑month period is capped at the fees you paid to us in that period. For free tier users, liability is capped at $100. We’re not liable for indirect, consequential, special or incidental damages (including loss of profit, revenue, data or goodwill) except where the law says we can’t exclude it.
  • We do not exclude liability for fraud, wilful misconduct, or personal injury/death caused by our negligence, or any other liability that cannot be excluded by law.
  • You are solely responsible for verifying any Output. We do not warrant the accuracy or appropriateness of any Output for your purposes.

7) Termination

  • You can stop using MIA and close your account at any time.
  • We may suspend or terminate your account if you break these Terms, pose a security or legal risk, or don’t pay for a Pro plan.
  • After termination, your access ends. You may export your Customer Data before closure; otherwise contact support. We delete or de‑identify remaining Customer Data as outlined in Section 3.

8) Privacy

Our Privacy Policy explains what we collect, how we use it, and your rights. We comply with the Privacy Act 1988 (Cth) and, where applicable, the GDPR. We ensure any overseas transfers are governed by data processing agreements or standard contractual clauses as required under law..

9) Changes to These Terms

We may update these Terms. For material changes, we’ll give at least 30 days’ notice (for example by email or in‑app). If you don’t agree, you may cancel before the change takes effect. If you continue to use MIA after the changes take effect, you are deemed to have accepted the new Terms.

10) Third‑Party Services

MIA may link to or integrate with third‑party services. Their terms and privacy policies apply to your use of those services.

11) Governing Law

These Terms are governed by the laws of New South Wales, Australia. You can bring claims in the courts of NSW. Local consumer protection laws may also apply.

Definitions (plain English)

  • Customer Data: What you or your users put into MIA (your content, files, prompts, and other data).
  • Output: Content generated by MIA from your input.
  • Free / Pro: Our plan types described on our pricing page.
  • We/Us: The provider of MIA.
  • You: the person or organisation using MIA.

If there is any conflict between this plain‑English summary and a translated version, this English version applies. Where these Terms conflict with the ACL or other non‑excludable laws, those laws apply.
