Exciting stuff. But\u00a0here\u2019s\u00a0the uncomfortable follow-up question: who\u2019s responsible when those autonomous systems do something they shouldn\u2019t? <\/p>\n\n\n\n<p>Welcome to AI governance\u00a0the trend I flagged in my\u00a0six predictions for 2026\u00a0that\u2019s\u00a0about to make compliance teams\u00a0very busy\u00a0indeed. And before you dismiss this as just another regulatory headache, consider this, Gartner projects that by 2026, 80% of organisations will formalise AI policies addressing ethical, brand, and data risks. Gartner also warns that over 2,000 \u201cdeath by AI\u201d legal claims could emerge this year due to insufficient guardrails. The question\u00a0isn\u2019t\u00a0whether you need AI governance.\u00a0It\u2019s\u00a0whether\u00a0you\u2019ll\u00a0build it proactively or have it imposed on you reactively.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Governance, Why Now?<\/h2>\n\n\n\n<p>Let\u2019s\u00a0be clear about\u00a0what\u2019s\u00a0changed. In 2024, US federal agencies introduced 59 AI-related regulations\u00a0more than double the previous year. Legislative mentions of AI rose across 75 countries. Meanwhile, 78% of organisations reported using AI, up sharply from 55% in 2023. The gap between AI adoption and governance maturity has become impossible to ignore.\u00a0<\/p>\n\n\n\n<p>CallMiner\u2019s\u00a0research captures the tension perfectly: 71% of organisations now have a dedicated AI governance function, yet 67% admit\u00a0they\u2019re\u00a0still deploying AI without the governance structures needed to manage risk.\u00a0We\u2019re\u00a0building the plane while flying it\u00a0and regulators have noticed.\u00a0<\/p>\n\n\n\n<p>To put\u00a0it bluntly.\u00a0AI oversight is transitioning from aspirational frameworks to binding requirements.\u00a0Expectations now include documented AI inventories, risk classifications, third-party due diligence, and model lifecycle controls. Governance will be measured by clear KPIs, not just policies on paper.\u00a0<\/p>\n\n\n\n<p>Perhaps most\u00a0significantly, governance boards that once guided AI adoption are giving way to compliance-led structures. As the EU AI Act and similar regulations come into force, oversight stops being advisory and becomes mandatory. Organisations will no longer ask <em>whether<\/em> they need guardrails.\u00a0They\u2019ll\u00a0focus on how fast they can implement them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Shadow AI Problem: Your Biggest Governance Gap<\/h2>\n\n\n\n<p>\u00a0Here\u2019s\u00a0a statistic that should concern every IT leader: according to\u00a0UpGuard, more than 80% of workers\u00a0including\u00a0nearly 90%\u00a0of security professionals\u00a0use unapproved AI tools in their jobs. Half say they do so regularly. And in a remarkable twist, executives have the highest levels of regular shadow AI use.\u00a0<\/p>\n\n\n\n<p>Shadow AI\u00a0isn\u2019t\u00a0new,\u00a0it\u2019s\u00a0the rebellious cousin of shadow IT. But while shadow IT involved rogue Dropbox folders and unauthorised project management apps, shadow AI is fundamentally more dangerous. These aren\u2019t\u00a0just unsanctioned apps;\u00a0they\u2019re\u00a0autonomous systems that learn, think, and act\u00a0often with access to sensitive data.\u00a0<\/p>\n\n\n\n<p>The risks are substantial.<\/p>\n\n\n\n<p><strong>Data exposure<\/strong>: when employees paste proprietary code or confidential strategy documents into public AI tools, that data may be logged, cached, or used for model training\u00a0permanently leaving organisational control.<\/p>\n\n\n\n<p><strong>Regulatory non-compliance<\/strong>: GDPR requires legal basis for processing personal data and the ability to erase it. Shadow AI tools bypass these safeguards entirely.<\/p>\n\n\n\n<p><strong>Untracked decisions<\/strong>: AI models can produce biased outputs or hallucinate facts that shape business decisions\u00a0with no audit trail of how or why.\u00a0<\/p>\n\n\n\n<p>Netskope\u2019s January 2026 report found that while the percentage of employees using personal AI apps dropped from 78% to 47% year-over-year, and company-approved account usage rose from 25% to 62%, organisations \u201cstill have work to do.\u201d The shift toward managed accounts is encouraging, but employee behaviour continues to outpace governance.\u00a0<\/p>\n\n\n\n<p>The solution\u00a0isn\u2019t\u00a0prohibition\u00a0bans tend to drive AI use further underground. Instead, organisations need to\u00a0provide\u00a0sanctioned alternatives that match the convenience of consumer tools, combined with clear policies,\u00a0monitoring, and education. As one analyst put it: \u201cOrganisations that try to ban AI will lose momentum. Those that govern it intelligently will gain both trust and velocity.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Regulatory Patchwork: What\u2019s Actually Enforceable<\/h2>\n\n\n\n<p>If you\u00a0operate\u00a0across borders, 2026 brings a fragmented compliance landscape with overlapping and sometimes inconsistent expectations. Here\u2019s\u00a0what\u2019s\u00a0actually enforceable:\u00a0<\/p>\n\n\n\n<p><strong>European Union \u2013 EU AI Act:\u00a0<\/strong>The big one. August 2,\u00a02026\u00a0brings full application to high-risk systems. Penalties reach \u20ac35 million or 7% of global revenue. Organisations must complete conformity assessments, establish risk management systems, and ensure human oversight mechanisms are operational. The Act classifies AI systems into four risk categories and completely bans \u201cunacceptable risk\u201d systems including harmful manipulation and social scoring. High-risk systems\u00a0including those used in employment, credit, and critical infrastructure face strict requirements around risk assessment, high-quality datasets, detailed documentation, and human oversight. Crucially, the EU AI Act is becoming the de facto global standard. Research shows\u00a0organisations not directly\u00a0impacted\u00a0are 22-33 points behind on AI controls. The regulation spreads globally through supply chain requirements, multinational operations, and competitive benchmarking.\u00a0<\/p>\n\n\n\n<p><strong>United States \u2013 Fragmented but Intensifying:\u00a0<\/strong>The US lacks comprehensive federal AI legislation, leaving agencies like the FTC, NIST, and Department of Commerce to interpret compliance within existing mandates. But state-level action is accelerating. The Colorado AI Act takes effect June 2026, requiring risk management policies, impact assessments, and transparency for high-risk systems. Illinois\u2019s AI in Employment Law (effective January 2026) mandates disclosure when AI influences employment decisions. The NIST AI Risk Management Framework provides voluntary but widely adopted guidance organised around four functions: Govern, Map, Measure, and Manage.\u00a0<\/p>\n\n\n\n<p><strong>United Kingdom:\u00a0<\/strong>Taking a principles-based approach through existing regulators rather than new AI-specific legislation. Comprehensive AI regulation has been delayed, creating flexibility but also uncertainty.\u00a0<\/p>\n\n\n\n<p><strong>Asia-Pacific:\u00a0<\/strong>Approaches vary significantly. Singapore has published agentic AI security guidelines and launched regulatory sandboxes. India\u2019s DPDP Act increases data protection complexity. China\u2019s updated Cybersecurity Law includes AI-specific provisions. The regional trend is toward sovereign AI ecosystems with localised governance requirements.\u00a0<\/p>\n\n\n\n<p><strong>Australia:&nbsp;<\/strong>The government\u2019s AI plan is expected to incorporate data localisation requirements, with organisations preparing for tighter sovereignty rules and mapping digital supply chains for cross-jurisdictional flexibility.&nbsp;<\/p>\n\n\n\n<p>The practical implication? Firms that treat AI governance as a documentation exercise rather than an operational discipline will struggle to\u00a0demonstrate\u00a0control when regulators come calling. Compliance is becoming a technical and strategic priority, not a downstream legal task.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Building Governance That Actually Works<\/h2>\n\n\n\n<p>So&nbsp;what does effective AI governance&nbsp;actually look&nbsp;like in practice? It starts with recognising that AI&nbsp;can\u2019t&nbsp;be governed from a single department&nbsp;it requires collaboration across legal, compliance, data science, cybersecurity, risk management, and business stakeholders.&nbsp;<\/p>\n\n\n\n<p><strong>Start with Discovery<\/strong>&nbsp;<\/p>\n\n\n\n<p>Before you can govern AI, you need to know what AI you have. Conduct a comprehensive inventory of all AI technologies in use including generative AI tools, embedded AI features in existing software, and yes, shadow AI deployments. Smarsh\u2019s guidance is direct: \u201cInventory AI-enabled tools and features, sanctioned or not. Map AI use cases to existing recordkeeping and supervision requirements.\u201d<\/p>\n\n\n\n<p><strong>Establish Clear Ownership<\/strong>&nbsp;<\/p>\n\n\n\n<p>Assign specific roles using RACI\u00a0methodology. Who builds AI systems? Who approves them? Who monitors them? Who\u2019s accountable when they fail? The emerging role of Chief AI Risk Officer is becoming standard in regulated industries\u00a0bridging technical AI expertise with risk management discipline. Forrester predicts 60% of Fortune 100 companies will appoint a head of AI governance in 2026.\u00a0<\/p>\n\n\n\n<p><strong>Fix Your Data Foundation<\/strong>&nbsp;<\/p>\n\n\n\n<p>AI governance extends data governance. Rigorous vendor management, ongoing compliance monitoring, and contractual provisions specifying responsibility for AI-related harms.\u00a0<\/p>\n\n\n\n<p>Implementation typically spans 6-12 months depending on organisational size and AI complexity. Train employees on risks\u00a0most misuse is unintentional.\u00a0<\/p>\n\n\n\n<p><strong>Invest in your compliance team.\u00a0<\/strong>With AI and automation reducing manual burden, compliance professionals are moving into more strategic roles guiding decisions around ethics, risk, and corporate integrity. The organisations that treat AI governance as strategic capability rather than compliance overhead will gain competitive advantage.\u00a0<\/p>\n\n\n\n<p><strong>Build for multiple\u00a0jurisdictions.\u00a0<\/strong>Global harmonisation efforts are gaining momentum, but regional regulations continue to diverge. Design governance frameworks that can flex across jurisdictions while maintaining operational consistency.\u00a0<\/p>\n\n\n\n<p><strong>Treat culture as a compliance risk.\u00a0<\/strong>Policies define boundaries, but culture defines behaviour.
